Resolution Authorizing Lease of Real Property
To Ventura County Fire Protection District
WHEREAS, the Ventura County Community College District (“District”) is the owner of certain real property commonly known as the former Oxnard Air Force Base consisting of approximately 43.27 acres and located in the County of Ventura, near the City of Camarillo, State of California (the “Camarillo Property”), subject to certain terms and conditions of the Quitclaim Deed pursuant to which the District acquired title to the Camarillo Property.
WHEREAS, since in or about 1993, the District has leased to the Ventura County Fire Protection District, a special district of the County of Ventura (“VCFPD”) certain portions of the Camarillo Property on which the VCFPD has constructed, operated and maintained professional fire training facilities and educational programs for District students and VCFPD personnel.
WHEREAS, the term of the current lease between the District and VCFPD expires on June 13, 2007, subject to earlier termination for certain portions of the leased premises as more particularly set forth therein, and leases a portion of the Camarillo Property measuring approximately 15.31 acres to VCFPD as depicted as Areas A, B and C in Exhibit “A” attached hereto and incorporated herein by this reference (the “Leased Premises”).
WHEREAS, the District and VCFPD desire to continue to work jointly toward the development and operation of programs and facilities to provide educational programs and vocational training for fire protection students and VCFPD personnel, including but not limited to enhancing the education of VCCCD’s students through fire academy training and providing professional training facilities for members of VCFPD and other public safety agencies.
WHEREAS, VCFPD desires to design, construct, install, operate and maintain a Fire Burn Simulator Facility in the northern portion of the Leased Premises at a cost estimated to be in excess of $4 million.
WHEREAS, VCFPD desires to design, construct, install, operate and maintain a dispatch Fire Communications Center on property adjacent to the District’s Camarillo Property and desires to lease an L-shaped strip of land along the northwest corner of the District’s Camarillo Property measuring approximately 311’ long, 20’4” wide along the Camarillo Property’s western boundary and approximately 345’ long, 44’ wide along the Camarillo Property’s northern boundary commencing at the northwest corner of the Camarillo Property (the “L-Shaped Strip of Land”) for the purpose of constructing and installing parking and related facilities for the Fire Communications Center and the Leased Premises.

WHEREAS, the L-Shaped Strip of Land lies to the northwest of the District’s existing fenceline and is improved with a drainage swale.
WHEREAS, pursuant to Education Code §81430, the District may lease for a term not exceeding 99 years to any public agency, including a special district, any real property owned by the District and which is not needed for school classroom buildings.
WHEREAS, pursuant to Education Code §81431, any such lease may be entered into upon such terms and conditions as the parties thereto may agree without complying with any other provisions of the Education Code.
WHEREAS, pursuant to Education Code §81432, prior to entering into such a lease, the District’s Board of Trustees is required to adopt by unanimous vote a Resolution authorizing such lease and prescribing the terms of the lease, which Resolution shall be published in a newspaper of general circulation within the District for once a week for three weeks prior to the execution of the lease.
NOW THEREFORE, IT IS HEREBY RESOLVED THAT the District’s Board of Trustees finds that the Leased Premises and the L-Shaped Strip of Land are not needed for school classroom buildings.
IT IS FURTHER RESOLVED THAT the Board of Trustees authorizes the District’s Chancellor, or designee, to enter into a lease with the Ventura County Fire Protection District pursuant to the provisions of Education Code §81430, et seq. to lease the Leased Premises and the L-Shaped Strip of Land to the VCFPD for a term to expire not later than June 30, 2034, with Areas B and C to continue as a year to year tenancy, subject to either party’s written notice to the other at least 180 days prior to the intended termination date, but in no event terminating any later than June 30, 2034.
IT IS FURTHER RESOLVED THAT the lease shall require that VCFPD use the Leased Premises and the L-Shaped Strip of Land subject to the terms and conditions of the Quitclaim Deed and in accordance with the following permitted uses: Area A: classroom and office facilities that pertain to instructional purposes, instructional training sites for field props, instructional parking area, storage of instructional aids, roof cutting props, Haz-Mat drill scenario area with props, rescue tower used for aerial and rope rescue operation, and Fire Burn Simulator Facility; Area B: instructional live fire and drill grounds associated with wildland fires; Area C: storage of instructional materials including concrete rubble for confine space rescue training and trench rescue props; and L-Shaped Strip of Land: parking and related facilities for the Fire Communications Center and the Leased Premises.
